OTIS RIDGE MEDICAL RELEASE FROM LIABILITY

I acknowledge that skiing, snowboarding, lessons, racing and race training, and other alpine activities (herein “Activities”), like many other sports, are hazardous, requiring the deliberate control and good judgment of the participant. These activities contain inherent risks including, but not limited to, the risks of personal injury, death, damages and/or property damage which may be caused by loading, riding, falling from, and unloading from ski lifts/chairlifts, variations in terrain, slope design, weather conditions, surface or sub-surface snow, ice, bare spots or areas of thin cover, moguls, jumps, ruts, bumps, roads, catwalks, other persons using the facilities, rocks, forest growth, debris, branches, trees, roots, stumps or other natural objects or man-made objects such as snowmobiles, snow machines, snow grooming equipment, signs, fence posts and on and off trail snowmaking equipment as well as many other hazards, that are incidental to the provision and/or maintenance of Otis Ridge (Otis Ridge herein shall include Otis Ridge Ski Area LLC, Otis Ridge Properties LLC, as well as its officers, officials, directors, shareholders, affiliates, agents, representatives, affiliated companies, and employees). I acknowledge that falls, injuries and collisions with other skiers/riders are a common occurrence in these Activities.

I authorize anyone working at Otis Ridge and/or the Otis Ridge Race Program (ORRP) to call for such medical care for anyone being registered for ORRP and/or Otis Ridge lesson programs including the Interclub and Tri-State (“Programs”) including the individuals being registered herein (“the Registrant”), and/or to transport the Registrant to the appropriate clinic or hospital if, in the opinion of anyone working or volunteering at Otis Ridge and/or ORRP, medical attention is needed. This agreement further authorizes a licensed physician or other recognized first aid room staff member to carry out emergency medical care deemed necessary for the Registrant in an emergency where normal permission is unavailable. I agree that upon transporting the Registrant to any medical facility, clinic, or hospital that the responsibility of ORRP and Otis Ridge shall be totally fulfilled and ORRP and Otis Ridge shall not have any further responsibility for the Registrant. I agree to indemnify and hold ORRP and Otis Ridge, their representatives, agents, affiliates, directors, servants and employees harmless from any costs incurred therein.

In consideration of being able to utilize Otis Ridge facilities and being able to register for the Programs, on behalf of myself, the Registrant, and our heirs, assigns, personal representatives and next of kin, (1) I acknowledge that participation in these Activities carries with it inherent risks including, but not limited to, those set forth herein and I voluntarily assume those risks, and (2) I FOREVER RELEASE AND FULLY DISCHARGE Otis Ridge with respect to any and all liability, loss, damage, costs, claims, and/or causes of action (including those of which I am not aware and those not mentioned in this release). This release further applies to all claims arising prior to execution of this release, including, but not limited to, injury, disability, death, or loss or damage to person or property related in any way to the use of Otis Ridge by myself and the Registrant, whether arising from the negligence of Otis Ridge or ORRP or conditions on or about the premises and facilities, or the operations of the ski area, including, but not limited to, ski and race instruction, grooming, snowmaking, equipment setting, lift operations and maintenance.

In consideration of being able to utilize Otis Ridge and participate in the Programs, I agree I will not make any claim nor bring any suit for any damages, injury or death to the participant which results from any inherent risks as I have agreed they are defined herein, and all other risks. I also agree that in the event that anyone makes any claims against Otis Ridge or ORRP, as a result of my activities or the Registrant, on its premises or the use of their facilities, that I will indemnify and hold harmless Otis Ridge and ORRP from such claims. MINIMUM SKIING/SNOWBOARDING AND LIFT RIDING REQUIREMENT I acknowledge that these Programs and the Registrant will be required at times to ride the lift alone or with a Otis Ridge skiing or snowboarding guest. I further agree and acknowledge that falls from lifts, including chairlifts, do occur and such falls are an inherent risk to riding such lifts and therefore inherent to the sport of skiing/snowboarding.
